1. Acceptance of these Terms

These Terms of Use ("Terms") govern your access to and use of the NyxintheMix mobile application (the "App") and the nyxinthemix.com website (the "Site"), together the "Service," operated by Fan2See Productions ("Fan2See," "we," "us," or "our"). By downloading, installing, or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

2. Eligibility and parental consent

The Service is intended for children roughly ages 1 through 3rd grade, to be used together with a parent, guardian, or other supervising adult. If you are that adult, you must be at least 18 years old (or the age of majority in your jurisdiction) to accept these Terms, and by setting up a child profile you represent that you are the child's parent or legal guardian, or are otherwise authorized to consent on the child's behalf. Children may not accept these Terms themselves or use the Service without such supervision.

3. Description of the Service

NyxintheMix is a musical STEM learning experience made up of story-driven missions, mini-games, a Parent Dashboard, and related content across age-appropriate "learning worlds." Features described as planned or "coming soon" (for example, a paid Family Membership or physical STEM kit activation) are not currently active and may change before launch.

4. License to use the Service

Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use the App, and to access the Site, solely for your own or your family's personal, non-commercial use. This license does not include any right to resell, sublicense, publicly perform, redistribute, or create derivative works from the Service, its characters, or its content.

5. Acceptable use

You agree not to, and not to permit a child in your care to attempt to:

• Reverse-engineer, decompile, or extract source code or assets from the App, except as permitted by law.
• Interfere with, disrupt, or attempt to gain unauthorized access to the Service or its infrastructure.
• Use the Service for any purpose other than personal, educational, non-commercial use.
• Misrepresent your identity or authority to consent on a child's behalf.

6. Intellectual property

The Service, including the character Nyx, Boop, the Rhythmville universe, all related names, logos, artwork, animation, music, sound effects, story content, and the "NyxintheMix" name and mark, are owned by Fan2See Productions or its licensors and are protected by copyright, trademark, and other intellectual property laws. No rights are granted to you other than the limited license in Section 4.

7. Purchases and subscriptions

As of the date above, the Service is free to use and does not offer any purchases within the child-facing experience. If we introduce an optional paid "Family Membership" or similar offering in the future, it will be presented only within the parent-gated area of the App, priced and billed through the applicable app store or payment processor, and governed by additional terms (including any refund policy) disclosed to you before purchase. We will never make a purchase available to a child directly, and we will never lock the ending of a free story episode behind a paywall.

Merch shop

Our Site includes an optional Shop for apparel and accessories, separate from the App. Shop orders are payment- processed by Stripe and printed and shipped by Printful, our third-party fulfillment partner; by placing an order you also agree to Stripe's and Printful's own terms of service for that transaction. Prices, shipping destinations, and estimated production times are shown at checkout before you pay. Because each item is printed to order, all sales are final except where a product arrives damaged, defective, or materially different from what you ordered — contact us at hello@fan2seeproductions.com and we will work with Printful to make it right. The Shop is intended for grown-ups; it is never presented to, or purchasable by, a child within the App.

8. No advertising to children

We do not display third-party advertising, sponsored content, or in-app purchase prompts within the child-facing experience, and we do not use loot boxes, randomized rewards, manipulative engagement mechanics, or countdown scarcity tactics anywhere in the Service.

9. Disclaimers

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, OR STATUTORY, INCLUDING WITHOUT LIMITATION WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT. We do not warrant that the Service will be uninterrupted, timely, secure, or error-free. Educational content within the Service is intended to supplement, not replace, formal instruction, professional developmental screening, or the judgment of a parent, guardian, or educator.

10. Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, FAN2SEE PRODUCTIONS AND ITS OFFICERS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF DATA, ARISING OUT OF OR RELATED TO YOUR USE OF THE SERVICE, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING OUT OF THESE TERMS WILL NOT EXCEED THE GREATER OF [amount to be specified] OR THE AMOUNT YOU PAID US, IF ANY, IN THE TWELVE MONTHS BEFORE THE CLAIM AROSE.

11. Indemnification

You agree to indemnify and hold Fan2See Productions harmless from any claim arising out of your misuse of the Service or your breach of these Terms, except to the extent caused by our own gross negligence or willful misconduct.

12. Termination

We may suspend or terminate your access to the Service at any time if we reasonably believe you have violated these Terms. You may stop using the Service at any time by uninstalling the App and, if applicable, deleting your child's profile through the Parent Dashboard.

13. Changes to the Service or these Terms

We may update the Service or these Terms from time to time. We will revise the "Last updated" date above when we do, and material changes will be communicated within the Parent Dashboard or by other reasonable means before they take effect. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

14. Governing law and disputes

These Terms are governed by the laws of [State/Country to be specified], without regard to its conflict-of-laws principles. Any dispute arising out of these Terms will be resolved in the courts located in [venue to be specified], and you consent to the personal jurisdiction of those courts, except where applicable law requires otherwise.

15. General provisions

If any provision of these Terms is found unenforceable, the remaining provisions will remain in full effect. These Terms, together with our Privacy Policy, constitute the entire agreement between you and Fan2See Productions regarding the Service.
